1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website at tds.oilrigsnow.com and related subdomains (the "Site"), operated by Total Drilling Supply LLC ("Total Drilling Supply," "Company," "we," "us," or "our"), located in Thompson, Connecticut 77040.

By accessing the Site, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are accessing the Site on behalf of a company, you represent that you have authority to bind that entity to these Terms.

2. About Total Drilling Supply

Total Drilling Supply is a consultancy specializing in the sale and sourcing of new and used land drilling rigs, mobile drilling rigs, offshore rigs and vessels, and oilfield equipment. We also assist with the purchase and sale of equipment parts, tubular goods, production equipment, oilfield services, and drilling rig financing.

Total Drilling Supply acts as a consultant and intermediary — not as a principal buyer or seller in most transactions. The terms of any specific transaction are governed by separate written agreements between the parties.

3. Use of the Website

Permitted Use

You may use the Site for lawful commercial purposes, including researching equipment, contacting us about listings, and accessing informational content.

Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of applicable laws
• Scrape, harvest, or systematically extract data from the Site without written consent

4. Equipment Listings & Pricing

You acknowledge that:

• Equipment availability changes rapidly — listings may not be current in real time
• Specifications (horsepower, depth rating, year, condition) are provided by sellers and may contain errors or omissions
• Photographs may not reflect the current condition of the equipment
• Pricing is preliminary and subject to change; final pricing requires a written quotation
• No transaction is complete until a signed written agreement is executed by all parties
• All equipment is sold "as-is" unless expressly stated otherwise in a written agreement

Professional inspection of any equipment prior to purchase is strongly recommended. Total Drilling Supply is not responsible for any loss or liability arising from reliance on listing information.

5. No Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Some jurisdictions do not allow exclusion of implied warranties; in such cases, exclusions apply to the maximum extent permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOTAL DRILLING SUPPLY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any dispute shall be resolved exclusively in the state or federal courts of Harris County, Texas, and you consent to personal jurisdiction there.

For international users: disputes will be resolved in Harris County, Texas, USA, under Texas law, regardless of where you are located.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be noted by updating the "Last Updated" date and posting a site notice. Continued use of the Site after changes constitutes acceptance of the revised Terms.
